Bacon Busters Waiver & Indemnity Form 2021

You are aware of and understand the scope, nature and extents of the risks involved in the Bacon Busters Comp and understand this entails the risk of injury and even death to you. These risks may include but are not limited to, risks involved in undertaking physical activity, undertaking endeavours at high speed, slips, trips, falls, physical stress and or injury, physical contact with other people, equipment or facilities, and/or exposure to climatic and environmental conditions. You voluntarily, freely and expressly choose to incur all risks associated with the Bacon Busters Comp, understanding that those risks may include personal injury, damage to property, and/or death.

You accept your responsibility to abide by the laws of the country, to ensure that you have adequate medical coverage, to protect your personal possessions and obey all rules set out for the Bacon Busters Competition Comp

You hereby irrevocably release Collinsville P&C, its members, officers, employees, agents and guests (“the Releasees”) from all liability, claims, demands, actions, proceedings or causes of whatsoever nature arising from loss, injury or damage to both property and person (including your death)arising out of your participation in Bacon Busters Comp whether due to any negligent act, breach of duty, default and/or omission on the part of you, the Releasees or any other person.

You hereby irrevocably indemnify the Releasees against all loss, damage, cost and expense whatsoever (including legal costs on a solicitor and own client basis) arising out of, or in connection with, any claims, demands, actions, proceedings or causes of any kind arising directly or indirectly out of your presence and/or participation in the Collinsville Bacon Busters Comp.

You agree not to institute any proceedings or action against the Releasees to the extent that the cause of action relates to the subject matter of this Deed. Should any such proceedings or action be commenced, you agree that the Releasees will be entitled to recover their legal fees and costs from you (on a solicitor and own client basis) incurred in defending any such proceedings or action.

You represent and warrant that you understand the terms of this Deed, you have capacity to enter into this Deed and that you enter into this Deed on your free will.

Any lawful, invalid or unenforceable term or condition of this Deed will not invalidate the balance of this Deed, but will be served from this Deed. This deed will not be interpreted against us merely because it was drafted by us. The word “include” or ” including” is not limited by what appears after that word. This Deed binds your personal representatives and other lawful representatives. Covenants in respect of a party comprising more than one person, apply jointly and severally.

I acknowledge and agree that my presence and participation in the Bacon Busters Comp is as a consequence of my own free will and desire and that I have read and understood the above assumption of risk and responsibility, release, indemnity, covenant not to sue, representations and interpretation.
